By accessing or using the INFOMAX FREIGHT Inc. website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

INFOMAX FREIGHT Inc. reserves the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms.


Services Description

INFOMAX FREIGHT Inc. operates as a licensed freight brokerage, connecting shippers with vetted motor carriers for the transportation of goods across the 48 contiguous United States.

Our services include arranging full truckload (FTL), less-than-truckload (LTL), expedited, flatbed, oversized, and refrigerated freight transportation. We do not own or operate trucks; we act as an intermediary between shippers and carriers.

All freight transportation is subject to carrier availability, regulatory requirements, and applicable tariffs.


User Responsibilities

When using our services, you agree to:

Provide accurate and complete information regarding your shipments, including origin, destination, freight description, weight, dimensions, and any special handling requirements.

Ensure that all freight tendered for shipment complies with applicable federal, state, and local laws and regulations.

Not tender hazardous materials without proper classification, labeling, packaging, and advance written disclosure to INFOMAX FREIGHT Inc.

Pay all charges for services rendered within the agreed-upon payment terms.


Freight Quotes and Pricing

Freight quotes provided by INFOMAX FREIGHT Inc. are estimates based on the information provided at the time of the quote request. Final pricing may vary based on actual shipment details, accessorial charges, fuel surcharges, and market conditions.

Quotes are valid for the timeframe specified at the time of quotation. Quotes that have expired must be re-quoted before booking.

Additional charges may apply for detention, layovers, re-delivery, driver assist, liftgate service, inside delivery, and other accessorial services not included in the original quote.


Claims and Liability

INFOMAX FREIGHT Inc. acts as a freight broker and is not liable for cargo loss, damage, or delay caused by the motor carrier during transportation.

In the event of cargo loss or damage, INFOMAX FREIGHT Inc. will assist in filing claims with the responsible carrier in accordance with the Carmack Amendment and applicable regulations.

All claims for loss or damage must be filed in writing within nine (9) months of the delivery date or scheduled delivery date. Claims filed after this period may be denied.

Shippers are encouraged to obtain appropriate cargo insurance for high-value or sensitive shipments.


Carrier Vetting and Compliance

INFOMAX FREIGHT Inc. conducts carrier vetting that includes verification of operating authority, insurance coverage, safety ratings, and compliance history through DOT-FMCSA databases.

While we exercise due diligence in carrier selection, INFOMAX FREIGHT Inc. does not guarantee the performance of any motor carrier and is not responsible for carrier actions or omissions during transportation.


Limitation of Liability

To the maximum extent permitted by law, INFOMAX FREIGHT Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services or website.

Our total liability for any claim arising from our services shall not exceed the brokerage fees paid by you for the specific shipment giving rise to the claim.


Intellectual Property

All content on the INFOMAX FREIGHT Inc. website, including text, graphics, logos, images, and software, is the property of INFOMAX FREIGHT Inc. and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.


Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.

Any disputes arising from these terms or our services shall be resolved in the state or federal courts located in DuPage County, Illinois.


Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
